Focusing on Load Safety

Load safety is a topic that is covered in drivers Periodic Training (DCPC) but what does it really mean and what are the consequences?
Load safety does not just apply to HGV drivers but to all drivers whether for personal or commercial use.
A vehicle must be fit and in a serviceable condition, having an insecure load is a breach of the requirement to maintain the vehicle as fit for purpose. The section 40A Road Traffic Act 1988 states “A person is guilty of an offence if he uses, or causes or permits another to use, a motor vehicle or trailer on a road when the weight, position or distribution of its load, or the manner in which it is secured, is such that the use of the motor vehicle or trailer involves a danger of injury to any person”
If a load is insecure, it is likely to be a danger or risk as it could fall from the vehicle or cause the vehicle to not operate as it should.
Why is load safety important?
Different types of cargo are carried all over the UK every day so ensuring they are loaded in the correct manner is imperative.
- It puts other road users at risk if the load is not secure.
- It can cause delays due to road/lane closure and let’s face it, no one wants to be stuck in traffic!
- It can cause a financial burden on businesses because of damage either to goods or infrastructure.
- It protects the driver from harm and potential fines and points.
The Basics of Load Safety
It is important the vehicle is firstly fit for purpose, the load is properly loaded and that the correct method has been chosen to secure it. Making sure the correct method has been chosen for a restrain system. Finally, the last basic tip is to ensure there is excellent communication between all parties. There are times where the driver has not loaded their vehicle themselves so they would need to know what to do if the load shifts, how to unload it and information on what they are carrying.
Consequences
Both driver and operator can receive penalties against them should something go wrong. Having the “it won’t happen to us” mentality won’t suffice. Unfortunately, there has been times were someone has lost their life whether it would be the driver themselves or a third party which is something heavy to carry on your conscience. Other consequences can include:
- Points and an unlimited fine
- Prosecution/legal proceedings
- Report to traffic commissioner
- Damaged reputation
- Other fines
- Loss of operator license
- Suspension or reduction in operator license
- Public enquiry
Hopefully this highlights the need for both employer and employees to understand that it is essential for all to comply with Health and Safety at Work. Employers and employees can work together ensure that load safety is the forefront of everyone’s minds.
